CONSTITUTION AND BY LAWS
OF THE
TAYLOR BAND BOOSTERS

TAYLOR, TEXAS  


CONSTITUTION PREAMBLE

The Taylor Band Booster organization will give encouragement to the total music program of Taylor ISD and, in particular, give support to a high quality band program.    All band parents are members of the Band Booster organization and support the continued development of each band student in the Taylor district.   The Band Booster organization supports high quality instruction and extracurricular experiences which contribute to the building of mature and responsible students.


ARTICLE I - NAME

The name of the organization governed by this constitution shall be the TAYLOR BAND BOOSTERS, located within the Taylor Independent School District, Taylor, Texas.


ARTICLE II - PURPOSE

The purpose of the Band Booster organization is to support and help maintain a first-class band program by:

1.   Maintaining clear communication and cooperation between the band members, their parents, the band directors, the school administration, and school board.

2.   Providing encouragement for the development and growth of a quality band program which complements and extends the educational options for band students as individual musicians and as members of a disciplined team,

3.   Providing financial support via fund-raising projects for the bands' unique needs that are outside the domain and purpose of school district revenues and goals, and are within the U.I.L. and school district policies and guidelines.


ARTICLE III -  MEMBERSHIP/DUES

1.   The membership shall consist of     ALL parents of band students currently enrolled in any of the TISD bands and anyone interest in supporting the band program.

2.    The membership year shall be June 1 - May 31.

3.   There are no membership dues.

ARTICLE IV - MEETINGS

1.   There shall be one (1) early August officers' meeting to plan and organize the fundraisers and projects for the coming year.

2.    There shall be at least five (5) announced open business meetings during the school year.


ARTICLE V - OFFICERS
1.   The officers of the Taylor Band Boosters shall be:
• President
• First Vice-President (fundraising)
• Second Vice-President  (concession stand)
• Third Vice-President  (social functions)
• Treasurer
• Secretary
• Historian/Publicist
• Taylor Middle School Representative
The offices of Vice-Presidents, and Historian/Publicist, may be held by two people.  There will be at least two Middle School Representatives, no more than three.

2.    The term of office is two consecutive membership years, June 1 - May 31.  

3.   No office shall be held consecutively for more than two years by an individual.

4.   Any officer absent for more than two regularly scheduled meetings without a valid excuse (illness, death in the family, out-of-town travel, etc)   may be removed from office and a replacement elected.

5.  An officer must have a child participating in the Taylor ISD band program.   The officer will have to resign from office to member status if no qualifying children of that officer are remaining in the band program.    The President will appoint a replacement.


ARTICLE VI - AMENDMENTS AND REVISIONS

1.   This constitution shall be amended only by a two-thirds majority vote of members present at any open meeting after 30 days notification to all officers, members, and directors.

2.   By Laws that do not conflict with the constitution shall be adopted and/or amended by a two-thirds vote at any open meeting after 30 days notification to all officers, members, and directors.

3.   No voting by proxy will be accepted.

ARTICLE VII - DISSOLUTION
Upon dissolution, all assets of the booster organization shall be liquidated and the funds shall be held and expended by Taylor ISD in accordance with the purposes of this organization until all such funds are expended.
BY LAWS


ARTICLE A - QUALIFICATION FOR OFFICE

1.   Members of a family may hold only one office for any given membership year.
2.   A candidate shall be present when elected, or have given previous consent.
3.   A candidate must have a child participating in the Taylor Independent School band program.

ARTICLE B - DUTIES OF OFFICERS

1.   PRESIDENT
• Schedule and preside over all meetings
• Appoint all appropriately needed committees and shall be an ex-officio member.
• Authorized to sign all checks when the Treasurer is unavailable.
• Review all new proposed projects with the band directors and principals per school guidelines
• Work with the band directors and officers to recommend a proposed budget at the start of each membership year
• Appoint replacement officers as needed.

2.   FIRST VICE-PRESIDENT
• Assist the President in all duties of that office and preside at meetings in the President's absence.
• Appoint, with the President's approval, a chairperson for each fundraising event.

3.   SECOND VICE-PRESIDENT
• Purchasing, stocking, and control of all concession stand food items and equipment, and control of the concession stand utilities.

4.   THIRD VICE-PRESIDENT
• Planning and organization of all social functions, including, but not limited to, the Band Banquet and receptions following concerts.
• Providing water and/or drinks for the band at all practice times, games, and events.
• Providing a yard sign for each incoming high school band student.
• Recognition of the Band Beau and Band Sweetheart.

5.   TREASURER
• Custodian of all funds of the organization
• Maintain financial records providing financial reports as required
• Pay all invoices
• Maintain all savings accounts
•  The financial records shall be audited once yearly during the month of May and once yearly at the discretion of the Executive Board by a person chosen by the President or School Administration.
• Ensure that the organization is operating with the correct tax status and that the year-end funds are sufficient to start up the concession stand the next year (voted on amount)
6.   SECRETARY
• Keep an accurate record of the organization's meetings, and make copies available to the School Administration.
• Be responsible for all Band Booster correspondence.

7.   HISTORIAN/PUBLICIST
• Report all notices of Band Booster meetings and publicity for band activities to the media.
• Publicize all fundraisers in the media
• Develop and send out a newsletter and e-mail updates.
• Maintain an e-mail band parent listing.
• Collect articles, programs, and pictures to include in the Band Booster minutes and the Band Council scrapbook

8.   MIDDLE SCHOOL OFFICERS (at least 2, no more than 3)
• Assist at Band Booster functions and fundraisers.
• Attend Band Booster meetings and officer meetings.
• Organize middle school parents.


ARTICLE C - ELECTION OF OFFICERS

1.   NOMINATING COMMITTEE - The president shall accept nominations from the floor for a nominating committee of three members at the meeting prior to the last meeting of the year.   The Nominating Committee shall present the nominees for vote at the last meeting of the membership year.   Nominations may be accepted from the floor.   The nominating committee members may also accept an office nomination.

2.   ELECTION OF OFFICERS - The election of all officers of the organization shall be a majority vote of all members present at the regularly scheduled meeting.   Should there be a tie vote for any office, reballoting for that office only will be necessary.   Voting will be via hands or written ballot.


ARTICLE D - QUORUM

1.    Regularly scheduled meetings do not require a definite quorum in order to conduct business.   However, all motions calling for amendments of the Constitution or By Laws must be ratified by a two-thirds majority vote of members present at the next regularly scheduled meeting.

2.   All called officers' meetings shall have at least fifty percent of the officers present to have a quorum.







ARTICLE E - AUTHORITY TO PURCHASE

1.  The authority to purchase shall be given to the President, Treasurer, First Vice-President, Second Vice-President, and Third Vice-President only for the necessary items to run their functions or for maintenance.   All other expenditures must be voted on and passed in a scheduled meeting or, in emergencies, by e- mail and/or phone tree vote.
2.   Emergency funds up to $300.00 may be appropriated for band needs by a majority vote of the officers.


ARTICLE F - AMENDMENTS

1.  Amendments shall be submitted at a regularly scheduled meeting, and, shall not be voted upon until the following regularly scheduled meeting.   A two-thirds majority vote of the members present shall be required for adoption of all amendments.

2.    By Laws may be adopted with provisions necessary for orderly administration of this organization.   However, should there by any inconsistency between the Constitution and the By Laws, the Constitution shall prevail.


ARTICLE G - RESTRICTIONS

1.   No part of the earnings of this organization shall be used for the benefit of any member, donor, officer, school employee, individual, corporation, or organization except in payment of reasonable compensation of goods or services actually rendered to or for this booster organization.

2.   No equipment shall be used for the benefit of any member, donor, officer, school employee, individual, corporation or organization without the express consent of the President and the Band Director.     This consent should also state any amount to be charged for use or breakage.
